Request from Developer, Meritage Homes of Florida, Inc., for an Extension to Complete Required Improvements

BACKGROUND
The final plat for Hampton Park PD Phase 2 was approved by the Board of County Commissioners on March 11, 2025 and the developer, Meritage Homes of Florida, Inc., a Florida profit corporation posted a Regions Bank Irrevocable Letter of Credit No. 55111484 in the amount of $216,617.91 (expiring on May 26, 2026) to guaranty the construction of the required improvements and entered into a Contract for Construction of Required Improvements No. PD-21-04-04 (2004040192-96959).

Developer has not yet completed the required improvements and by letter dated February 10, 2026, has requested an extension to February 25, 2027 to complete the required improvements. The developer will present an amendment to the existing letter of credit which extends the letter of credit expiration date to May 25, 2027 and is 90 days beyond the requested extension date.

Section 913.10(1)(E) of the County Code states that for good cause shown the Board may in its discretion grant one or more extensions of time for performance of any contract for construction of required improvements provided the surety supporting such contract remains valid for the required 90-day period following the newly extended time for performance.

Engineering has no objection to the requested extension to complete the required improvements, as the homes in this phase have not yet begun to be constructed.

BUDGETARY IMPACT
There is no cost to the County associated with extending the completion deadline to February 25, 2027.
