BACKGROUND
The Public Works Department required the construction of 16th Street and the reconstruction of 98th Avenue in conjunction with site plan approval for the FPL Indian River Service Center at 1575 98th Avenue. Matt Soyka, P.E., served as the project engineer for the FPL Service Center, while James Ennis, P.E., oversaw the road construction. These projects occurred during the COVID-19 lockdown, during which Mr. Soyka worked remotely. While he conducted site visits for the FPL project, he did not formally inspect 16th Street or 98th Avenue during construction.
In November 2023, drainage concerns began to emerge at the adjacent Mixon property (Riverside Drenching Inc.). Mr. Soyka was assigned as project coordinator on April 24, 2025. The original survey for the improvements did not identify a drainage connection from the Mixon property to either 16th Street or 98th Avenue. Brian Good, P.E., of Kimley-Horn, later acknowledged this oversight and developed a plan to resolve the issue.
ANALYSIS
The proposed design includes installation of a new pipe to restore drainage from the Mixon property to the 16th Street stormwater system, replacing the original connection lost during prior construction. The design has been reviewed and agreed upon by Mr. Mixon, Indian River County Public Works, and the Indian River Farms Water Control District (IRFWCD).
The proposal from Timothy Rose Contracting Inc. totals $49,360.00. Given potential complications during the rainy season, staff recommends an 11.43% contingency, increasing the total project budget to $55,000.00. The Board is asked to waive the requirement for three written quotes for work above $10,000.
To prevent future occurences of this nature, when a Land Development project and an Engineering CIE project are combined, a single Division or Project Engineer/Manager be designated as the Lead. This Lead will be responsible for maintaining clear and consistent communication throughout the project lifecycle, from pre-construction coordination through active construction and final project closeout. This approach will help ensure that all required checklists are completed, and any known deficiencies are identified and addressed in a timely manner.
BUDGETARY IMPACT
Funds in the amount of $55,000 will be made available via budget amendment from the Optional Sales Tax/Road & Bridge/FPL IR Service Center Roadway Improvement acount, number 31521441-066510-21001.
POTENTIAL FUTURE BOARD ACTIONS
No future Board action is required or unless additional authorization is needed. The requested contingency should address potential weather-related challenges during construction.
