SUBJECT: Release of Retainage and Change Order No. 1, Waters Edge Culvert Replacement (IRC-2201)

BACKGROUND
The Waters Edge Culvert Replacement Project is located on 1st St. SW between 35th Avenue and 37th Drive SW. The project was constructed in two phases. The first phase included the replacement of the aging 60-inch corrugated metal drainage culverts with reinforced concrete pipe (RCP) under the entrances to the Waters Edge neighborhood at 36th Court SW and 37th Drive SW. The County funded the construction of this phase and will be reimbursed by the Waters Edge Phase II Homeowners Association of Vero Beach, Inc. through a special assessment.
The second phase, solely funded by the County, included the replacement of the aging 96-inch corrugated metal culvert under 1st SW with a concrete box culvert that connects the north and south sections of the Indian River Farms Water Control District Coouch Ditch, and replacement of a 24-inch corrugated metal drainage pipe crossing 1st SW with a 24-inch RCP. Ancillary work included clearing, canal excavation, embankment stabilization, grading, sod, roadway milling and resurfacing, striping, curb, driveway aprons, and guardrail replacement.
ANALYSIS
Bid No. 2024046 was awarded to Timothy Rose Contracting, Inc. in the total amount of $1,366,739.45 and was comprised of two components - Waters Edge Phase II Homeowners Association of Vero Beach, Inc. $537,974.50 and Indian River County $828,764.95.
Change Order No. 1 is to make final adjustments to Water’s Edge Phase II HOA’s portion by decreasing the cost by $85,201.60 to a total of $452,772.90.
The County’s portion was originally bid at $828,764.95 and is being decreased by $97,157.75 to $731,607.20.
Change Order No. 1 reflects the final reconciliation of quantities and costs and includes necessary adjustments to complete the project. Change Order No. 1 in the amount of $182,359.35 decreases the original total of $1,366,739.45 to a final total contract price of $1,184,380.10.
Timothy Rose Contracting, Inc. has been paid $1,125,161.09 to date with $59,219.01 held in retainage. Timothy Rose Contracting, Inc. submitted Application for Payment No. 2201-7 FINAL for release of retainage in the amount of $59,219.01.
BUDGETARY IMPACT
Funds in the amount of $59,219.01 are budgeted in the Optional Sales Tax/Retainage/Retainage-Tim Rose Contracting account, number 315-206000-21017.
Refunds will be issued to residents who prepaid the assessment fee to account for the decrease in price, and the Tax Collector and Property Appraiser’s offices will be notified of the decrease in the overall charge.
PREVIOUS BOARD ACTIONS
The Board of County Commissioners awarded Bid No. 2024046 to Timothy Rose Contracting, Inc. in the amount of $1,366,739.45 on June 18, 2024.
On August 12, 2025, the Board of County Commissioners adopted Resolution No. 2025-034 (Initial Assessment Resolution).
On September 10, 2025, the Board of County Commissioners adopted Resolution No. 2025-044 Final Assessment Resolution for Waters Edge Phase II Culvert Replacement Project that approves the Assessment Roll and imposition of assessments to fund the cost of the culvert replacement project.

STAFF RECOMMENDATION
Recommended Action
Staff recommends approval of Change Order No. 1 and payment of Contractor’s Application for Payment No. 2201-7 FINAL in the amount of $59,219.01 for release of retainage, contingent upon receipt of all subcontractor final lien releases.
Refunds will be issued to residents who prepaid the assessment fee to reflect the decreased project cost. The Tax Collector and Property Appraiser will also be notified of the reduction in the overall charge.
